HGV Logbook Terms of Use

These Terms of Use apply to the HGV Logbook Android application, website, User Guide and associated services provided by Brett Green.

By downloading, installing or using HGV Logbook, you agree to these Terms of Use.

1. About HGV Logbook

HGV Logbook is a digital logbook designed to help HGV drivers record and organise information relating to their working day.

Features may include recording:

• Shift start and finish times

• Working hours and breaks

• Vehicle mileage

• Truck and trailer details

• Deliveries

• Arrival and departure times

• Trailer changes

• Notes

• Proof of Delivery (POD) photographs

• Working Week reports

• PDF reports

• Backup and Restore information

Features may be changed, improved, added or removed as HGV Logbook develops.

2. HGV Logbook Is a Record-Keeping Tool

HGV Logbook is provided as a tool to assist drivers with organising and maintaining their own working records.

The app does not replace the driver's legal responsibilities, official tachograph records, employer records or any records that must be maintained under applicable transport, working-time, road-safety or other laws and regulations.

Users remain responsible for ensuring that they comply with all rules and requirements applicable to their work.

3. Accuracy of Records

Information recorded in HGV Logbook is primarily entered or selected by the user.

The user is responsible for checking that information such as times, mileage, vehicle details, deliveries, breaks, notes and other records is correct.

HGV Logbook should not be relied upon as the sole means of determining whether a driver is legally permitted to drive, work or continue a shift.

Where official records differ from information stored in HGV Logbook, users should rely upon the appropriate official records and applicable legal requirements.

4. Driver Safety

HGV Logbook must only be used when it is safe and lawful to do so.

Do not operate HGV Logbook while driving.

Drivers should stop and park safely before entering, reviewing, photographing, editing or sharing information using the app where interaction with the device would otherwise distract from driving.

The user is responsible for complying with laws and workplace rules concerning mobile-device use while driving.

5. Proof of Delivery Photographs

HGV Logbook allows users to capture and store Proof of Delivery photographs.

Users are responsible for ensuring that they have permission or another lawful basis to photograph, store, use and share documents or other information captured using the POD feature.

Users should avoid unnecessarily capturing personal, confidential or sensitive information.

HGV Logbook does not guarantee that a POD photograph will be accepted by an employer, customer, delivery location, court, regulator or other organisation as official proof of delivery.

6. Reports and PDF Documents

HGV Logbook can generate reports and PDF documents using information recorded in the app.

These reports are intended to help users organise and present their records.

Users should check generated reports before relying upon, submitting or sharing them.

HGV Logbook does not guarantee that a generated report will satisfy the specific record-keeping requirements of an employer, customer, regulator or other organisation.

7. Backup and Restore

HGV Logbook provides Backup & Restore functionality and may create automatic local backups.

Users remain responsible for maintaining appropriate backups of information they consider important.

Although reasonable efforts are made to provide reliable backup and restore functionality, no electronic storage or backup system can guarantee that information will never be lost, damaged or become unavailable.

Users should keep important exported backup files in a safe location.

8. User Data

HGV Logbook stores its principal working records locally on the user's device.

Users are responsible for protecting their device and any exported backups, reports, POD photographs or other files created using HGV Logbook.

The handling of information is described in the separate HGV Logbook Privacy Policy.

9. Sharing and Exporting Information

HGV Logbook may allow users to share or export reports, POD photographs, backup files and other information.

The user is responsible for selecting the correct recipient and ensuring they are authorised to share that information.

Once information has been intentionally transferred to another person, application, device or service, its subsequent storage and use may be outside HGV Logbook's control.

10. Google Play

HGV Logbook may be downloaded and updated through Google Play.

Use of Google Play is also subject to Google's applicable terms and policies.

Availability through Google Play does not mean that Google operates, endorses or accepts responsibility for the records users create within HGV Logbook.

Future versions of HGV Logbook may be distributed through Google Play as updates become available.

11. Updates

HGV Logbook may receive updates containing new features, improvements, compatibility changes, security improvements or bug fixes.

Users are encouraged to keep HGV Logbook and their Android device reasonably up to date.

Older versions may eventually become unsupported or may not contain the latest functionality.

12. Acceptable Use

You must not deliberately use HGV Logbook to:

• Break applicable law

• Store or distribute unlawful material

• Infringe another person's rights

• Attempt to interfere with or damage the app

• Reverse engineer or misuse HGV Logbook except where applicable law expressly permits it

• Misrepresent records with the intention of deceiving another person or organisation

13. Availability

Reasonable efforts are made to keep HGV Logbook reliable and usable.

However, uninterrupted or error-free operation cannot be guaranteed.

Features may occasionally be unavailable because of device issues, Android changes, updates, faults or circumstances outside the developer's reasonable control.

14. Compatibility

HGV Logbook is designed for supported Android devices.

Operation may vary depending on Android version, device manufacturer, available storage, system configuration and other software installed on the device.

Compatibility with every Android device or future Android version cannot be guaranteed.

15. Third-Party Services

HGV Logbook may provide access or links to external services such as Google Play, Google Sites, Google Drive, Google Forms, YouTube, email applications or Android sharing facilities.

Those services are operated independently and may have their own terms, privacy policies and availability requirements.

HGV Logbook is not responsible for the operation or content of independent third-party services.

16. Intellectual Property

HGV Logbook, including its name, branding, logo, application design, documentation and original content, is owned by Brett Green, except where third-party components or materials are separately identified.

These Terms do not transfer ownership of HGV Logbook or its intellectual property to the user.

17. Limitation of Liability

To the fullest extent permitted by applicable law, HGV Logbook is provided without guarantees that it will meet every individual user's requirements or remain completely free from errors.

The developer is not responsible for losses resulting solely from inaccurate information entered by a user, failure to maintain appropriate backups, misuse of the application, unauthorised sharing of information, or use of HGV Logbook contrary to these Terms.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights that cannot legally be excluded under applicable consumer law.

18. No Professional or Legal Advice

Information provided through HGV Logbook, its website, User Guide or support materials is intended to explain and assist with use of the application.

It does not constitute legal, employment, transport-compliance, financial or other professional advice.

Where necessary, users should obtain appropriate professional advice concerning their individual circumstances.

19. Ending Use of HGV Logbook

Users may stop using HGV Logbook at any time.

Before uninstalling the application or clearing its data, users should create and safely store any backup or reports they wish to retain.

Uninstalling HGV Logbook or clearing application data may result in locally stored information becoming unavailable.

20. Changes to These Terms

These Terms of Use may be updated to reflect changes to HGV Logbook, applicable requirements or services associated with the application.

The Last updated date at the top of this page will be changed when the Terms are revised.

Continued use of HGV Logbook after an updated version takes effect will be subject to the updated Terms to the extent permitted by applicable law.

21. Governing Law

These Terms are governed by the laws applicable in England and Wales, subject to any mandatory rights or protections that apply to the user.

Nothing in these Terms removes any statutory rights that cannot lawfully be excluded.
